Echobeat Terms of Service

1. Introduction
Welcome to Echobeat, a booking management platform for music artists, booking agents, and promoters. By accessing or using Echobeat ("Platform" or "Service"), you agree to comply with these Terms of Service ("Terms"), which govern your use of our website, applications, and any associated services.
These Terms form a legally binding agreement between Echobeat Ltd ("Echobeat", "we", "us", "our") and any user ("User", "you") accessing or using our Platform. If you do not agree with these Terms, you must not use Echobeat.
2. Definitions
"User" refers to any individual or entity using Echobeat, including but not limited to artists, booking agents, event promoters, and managers.
"Platform" refers to the Echobeat website, applications, APIs, link-in-bio pages, booking tools, and all related services for artist management, booking, and communication.
"Agreement" refers to these Terms and any policies referenced herein.
"Content" includes all data, text, graphics, files, photos, and other materials provided by Users or Echobeat.
3. Eligibility & Account Registration
To use Echobeat, you must:
- Be at least 18 years old.
- Provide accurate and complete registration information.
- Keep your login credentials secure and confidential.
- Be authorized to create an account if registering on behalf of a business.
Echobeat reserves the right to suspend or terminate accounts suspected of unauthorized or fraudulent activity. Echobeat may verify identities but does not guarantee the authenticity of any User.
4. Use of Services
4.1 Acceptable Use
Users may create personalized booking pages, including embeddable link-in-bio tools, to manage artist bookings, display availability, and facilitate direct communication with promoters or agencies through Echobeat’s integrated messaging system. Users agree to:
- Use Echobeat only for lawful purposes.
- Not engage in spam, fraud, or abusive behavior.
- Not interfere with the proper functioning of the Platform.
We reserve the right to remove content, suspend accounts, or take legal action against violations of these Terms. By signing up for Echobeat, you agree to receive occasional emails, including platform updates, promotions, and industry insights.
4.2 Booking & Payment Processing
Users may create, accept, or manage bookings through Echobeat. Payments may be processed through third-party payment providers (e.g., Stripe, PayPal). Echobeat is not a party to any contract between Users, and does not own or control the services listed. Echobeat is not responsible for disputes between Users regarding bookings or payments.
4.3 Contracts, Invoices & Document Management
Users may create, send, and sign contracts and invoices directly through Echobeat. Echobeat is not a legal party to any contract signed between Users and does not provide legal advice. Users are responsible for ensuring compliance with applicable contract laws when using Echobeat for agreements.
5. Content Ownership & Rights
5.1 User-Generated Content
Users retain ownership of content they upload but grant Echobeat a non-exclusive, royalty-free license to use such content (e.g., images, artist profiles) for the operation of the Platform. Echobeat is not liable for any content posted by Users.
5.2 Intellectual Property
All trademarks, logos, and proprietary content of Echobeat are the exclusive property of Echobeat and may not be used without prior written permission.
6. Subscription Plans & Fees
Some features of Echobeat may require a paid subscription. By subscribing, you agree to:
- Pay the listed fees for your chosen plan.
- Automatic renewal of subscriptions unless canceled before the renewal date.
- No refunds for unused periods unless required by applicable law.
7. Account Suspension & Termination
We reserve the right to:
- Suspend or terminate accounts violating these Terms.
- Modify, discontinue, or remove Platform features at any time.

8. Limitation of Liability
To the extent permitted by law, Echobeat is not liable for:
- Any indirect, incidental, or consequential damages arising from your use of the Platform, including but not limited to lost revenue, missed bookings, or performance disputes.
- Errors, delays, or technical malfunctions affecting service availability.
Users agree to indemnify and hold harmless Echobeat from any claims or liabilities arising from their use of the Platform, including but not limited to contract disputes, property damage, or legal claims related to a performance.
9. Data Privacy & Security
Echobeat processes personal data in accordance with its Privacy Policy. Users are responsible for protecting their own login credentials and data. Third-party services may have their own privacy policies, which Users should review separately.
10. Dispute Resolution
Any disputes arising from these Terms shall be resolved through good-faith negotiations. If unresolved, disputes shall be subject to the jurisdiction of England and Wales courts.
11. Changes to These Terms
Echobeat reserves the right to modify these Terms at any time. Changes will be posted on the Platform, and continued use constitutes acceptance of the new Terms.
